Brazilian legislation has always treated aeronautical law as a specific legal discipline. The 1934 Constitution already referred to air navigation and air law as a private activity and exclusive legislative competence of the Union.

Over time, and with regard to social and business interest, public or private, of the various aspects covered by aeronautical law, it appears that the principles that integrate it have their sources mainly in other branches of law, as well as law constitutional (international treaties), administrative law (concession or permission of air services, airport systems, control bodies and commissions), civil and commercial law (civil liability, aircraft contracts, leasing, chartering, mortgage, chattel mortgage, leasing, insolvency).
